1. Introduction

AreTech Computer Education and Skill Council (“ACE Skill Council”) is dedicated to expanding access to quality computer education and skill development across India. Our franchise policy outlines the terms and conditions under which we grant franchises to individuals or organizations (“Franchisees”) to operate ACE Skill Council centers.

2. Eligibility Criteria

To be considered for an ACE Skill Council franchise, applicants must meet the following criteria:

• Educational Background: A strong background in education, particularly in computer science or related fields, is preferred.
• Financial Stability: The applicant must demonstrate the financial capability to invest in and sustain the franchise, including initial setup costs and ongoing operational expenses.
• Location: The proposed location must be in a suitable area with potential demand for computer education and skill development.
• Experience: Prior experience in the education sector, business management, or franchising is advantageous.

3. Franchise Application Process

• Application Submission: Interested parties must submit a formal application, including personal, financial, and business details, along with the proposed location.
• Review and Approval: ACE Skill Council will review the application, conduct interviews, and assess the suitability of the applicant and location. Successful applicants will be notified of their approval.
• Franchise Agreement: Approved applicants will be required to sign a franchise agreement that outlines the rights, responsibilities, and obligations of both parties.

4. Franchise Fee and Investment

• Franchise Fee: A one-time, non-refundable franchise fee is required to secure the franchise rights. The fee amount will be specified in the franchise agreement.
• Initial Investment: Franchisees are responsible for the initial investment required to set up the ACE Skill Council center, including infrastructure, equipment, marketing, and staff recruitment.
• Ongoing Fees: Franchisees are required to pay ongoing royalty fees, typically calculated as a percentage of revenue, and may also contribute to a national marketing fund.

5. Rights and Obligations of Franchisees

• Brand Usage: Franchisees have the right to use ACE Skill Council brand, trademarks, and proprietary materials in accordance with the franchise agreement.
• Curriculum Delivery: Franchisees must deliver ACE Skill Council’s educational programs as per the approved curriculum and teaching standards.
• Quality Assurance: Franchisees must maintain high standards in all aspects of operation, including teaching, student assessment, and facility management. ACE Skill Council reserves the right to conduct regular audits and inspections.
• Staffing: Franchisees are responsible for hiring, training, and managing staff. ACE Skill Council will provide initial training and ongoing support as needed.
• Marketing: Franchisees must conduct local marketing activities in compliance with ACE Skill Council’s branding guidelines. ACE Skill Council may also implement national campaigns, with franchisees contributing to the marketing fund.

6. Training and Support

• Initial Training: ACE Skill Council will provide comprehensive initial training to franchisees and their key staff, covering curriculum delivery, operational procedures, and business management.
• Ongoing Support: Franchisees will receive ongoing support through regular updates, training sessions, and access to the latest educational resources. ACE Skill Council’s support team will be available for consultation on operational challenges.

7. Performance Monitoring

ACE Skill Council will monitor the performance of each franchise through regular reports, audits, and evaluations. Key performance indicators (KPIs) such as student enrollment, retention rates, and financial performance will be assessed.

8. Term and Renewal

• Franchise Term: The initial franchise term is 1 years.
• Renewal: Franchisees may apply for renewal at the end of the term, subject to performance review and mutual agreement. Renewal may involve additional fees and signing a new franchise agreement.

9. Termination of Franchise

The franchise agreement may be terminated by ACE Skill Council under the following circumstances:

• Breach of Agreement: Failure to comply with the terms of the franchise agreement, including non-payment of fees, poor quality standards, or unauthorized use of ACE Skill Council’s intellectual property.
• Voluntary Termination: Franchisees may terminate the agreement by providing written notice as specified in the franchise agreement.
• Consequences of Termination: Upon termination, the franchisee must cease all use of ACE Skill Council’s branding, return proprietary materials, and settle any outstanding financial obligations.

10. Intellectual Property

All intellectual property, including trademarks, logos, course content, and teaching materials, remain the exclusive property of ACE Skill Council. Franchisees are granted a non-exclusive, non-transferable license to use ACE Skill Council’s intellectual property during the term of the franchise agreement.

11. Dispute Resolution

Any disputes arising from the franchise agreement shall be resolved through arbitration in accordance with the [Insert Applicable Law] in India. The decision of the arbitrator shall be final and binding on both parties.

12. Amendments

ACE Skill Council reserves the right to amend this Franchise Policy from time to time. Any changes will be communicated to franchisees in writing.
